§1 Applicability to Consumers and Definitions

These General Terms and Conditions apply to all contracts concluded via our online store at linechaser.store between us,

and the customer in the version valid at the time the contract is concluded. Any deviating general terms and conditions of the customer will not be recognized unless we expressly agree to their validity in writing.

These Terms and Conditions apply to contracts for the sale of costume jewelry and other goods offered in the online shop to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity (Section 13 of the German Civil Code (BGB)).

The offer is directed at customers in Germany as well as in the member states of the European Union expressly listed in the online shop (during the ordering process). Deliveries are made exclusively to the countries selectable during the ordering process.

§2 Formation of a Contract, Storage of the Contract Text

(1) The presentation and promotion of products in the online store do not constitute a legally binding offer, but rather a non-binding invitation to the customer to place an order.

(2) By submitting the order via the “Buy Now” button or a similarly clearly labeled order button, the customer makes a binding offer to conclude a purchase contract for the goods contained in the shopping cart.

(3) The customer may review their information at any time before submitting the order and make changes using the correction tools provided during the ordering process. The ordering process can also be canceled at any time by closing the browser window.

(4) Receipt of the order will be confirmed to the customer immediately by email. This confirmation of receipt does not constitute acceptance of the contract offer unless acceptance is expressly stated therein.

(5) The contract is not concluded until a shipping confirmation is issued or the goods are shipped.

(6) We will send the customer the order details, these Terms and Conditions, and the cancellation policy, including the sample cancellation form, if applicable, via email.

(7) The language of the contract is German or English. The language selected during the ordering process shall prevail. We will store the text of the contract and send it to the customer in writing via email no later than with the shipping confirmation. We do not guarantee that the text of the contract will be permanently stored in the online store beyond this.

§3 Products and Product Presentation

The essential characteristics of the goods are set forth in the respective product descriptions in the online shop.

For fashion jewelry, minor deviations in color, finish, texture, size, shape, or weight may occur, provided these are customary in the trade and do not significantly impair the item’s usability. Color deviations may also be caused by different screen and display settings.

Material specifications, dimensions, care instructions, and, where applicable, wearing instructions or warnings are provided on the respective product page and the care instructions page.

§4 Prices and Payment Terms

(1) Prices

All prices listed in the online store are total prices in euros or the respective local currency and include applicable sales tax as well as other price components. Shipping costs may apply and will be shown separately during the ordering process. The applicable total price, including any shipping costs, depends on the country of delivery and will be displayed to the customer in the order form before the order is submitted. Information on shipping costs, delivery countries, and delivery times is also available in our FAQ.

(2) Payment Terms

Payment is made via the payment methods offered in the online shop, in particular PayPal, credit card, Klarna, Apple Pay, and Google Pay. The respective terms and conditions of the payment service provider apply in addition. We reserve the right to exclude certain payment methods in individual cases for objective reasons, in particular due to a security check or technical availability. Refunds will be issued via the payment method used when placing the order.

Information about Klarna
If Klarna is offered as a payment method, payment processing is handled by Klarna. Klarna’s terms and conditions apply in addition. When using Klarna, additional requirements—in particular a credit check—may apply depending on the selected payment method.

(3) Gift Certificates

Gift certificates issued by us may be redeemed in the online store, provided this option is available during the ordering process. The value of the gift certificate will be applied to the total order amount. Any remaining balance must be paid using one of the available payment methods. Cash redemption of gift certificates or remaining balances is not permitted.

§5 Delivery and Delivery Time

(1) Delivery is made to the delivery address provided by the customer in the countries listed in the online store. The estimated delivery times are based on the information provided in the online store. Unless a different delivery time is specified there, the delivery time within Germany is 3 to 7 business days and to other EU member states 3 to 14 business days from the conclusion of the contract. The period begins on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next business day. If the goods are unavailable, the customer will be informed immediately. Any payments already made will be refunded immediately, at the latest within 14 days.

(2) For consumers, the risk of accidental loss and accidental deterioration of the goods is not transferred until the goods are handed over to the customer.

(3) The customer must provide a complete and correct delivery address. If a delivery cannot be made due to incomplete or incorrect address information and the customer is responsible for this, the customer shall bear the resulting additional costs, to the extent that they are necessary and reasonable. In this case, a redelivery will only take place after prior consultation and, if applicable, upon reimbursement of the shipping costs incurred for this purpose.

§6 Retention of Title

The goods remain the property of LINE Chaser Lifestyle UG (limited liability) until the purchase price has been paid in full.

§7 Right of Withdrawal

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a person designated by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement. You may use the attached model withdrawal form for this purpose, though this is not mandatory. The withdrawal may be submitted by mail or email.

Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs, with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us, without delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us immediately and, in any case, no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period expires.

You are responsible for the direct costs of returning the goods. You are only liable for any loss in value of the goods if such loss is attributable to handling of the goods that goes beyond what is necessary to assess their nature, characteristics, and functioning.

Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the buyer is decisive, or that are clearly tailored to the buyer’s personal needs, as well as to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

§8 Damage During Transport, Liability, Warranty, and Guarantee

(1) Damage During Transport
If goods are delivered with obvious damage caused during transport, the customer is asked to report such damage to the delivery person as soon as possible and to notify us immediately. Failure to file a complaint does not affect the customer’s statutory rights regarding defects.

(2) Warranty
For consumers, the statutory warranty rights apply. The warranty period for new goods is two years from the date of delivery.
In the event of defects, the customer is entitled to the statutory rights to subsequent performance. Within the framework of the statutory provisions, the customer may initially demand repair or replacement.
If the subsequent performance fails, is unreasonable, or is refused by us, the customer may, in accordance with statutory provisions, reduce the purchase price or withdraw from the contract. Any further claims by the customer are governed by statutory provisions.

(3) Warranty
An additional warranty exists only if it is expressly stated for the respective item or in a separate warranty statement.

(4) Liability
We are fully liable for intentional acts and gross negligence, as well as for culpable injury to life, limb, or health. In the event of a breach of essential contractual obligations due to slight negligence, our liability is limited to foreseeable damages typical for this type of contract. Essential contractual obligations are obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance the customer may regularly rely. Otherwise, liability is excluded to the extent permitted by law. Liability under the Product Liability Act remains unaffected.

§9 Gift Certificates

Promotional gift certificates issued free of charge as part of promotional campaigns may only be redeemed under the terms and conditions specified at the time of issuance. Gift certificates may be redeemed in the online store unless otherwise agreed. Cash redemption is excluded to the extent permitted by law. The validity period, redeemability for discounted items, transferability, minimum order value, and any remaining balance are subject to the terms and conditions specified at the time the voucher is issued.

§10 Customer Account

If a customer account is offered, the customer is obligated to keep their login credentials confidential and not to disclose them to any unauthorized third party. We reserve the right to suspend or delete customer accounts in the event of violations of these Terms and Conditions or for other valid reasons.

§12 Governing Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. With respect to consumers whose habitual residence is in another member state of the European Union, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.

§13 Dispute Resolution

The European Commission provides a platform for online dispute resolution (https://ec.europa.eu/consumers/odr/).

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§15 Final Provisions

Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provisions.
